A Substance Abuse Professional (SAP) is required when an individual has a DOT drug and/or alcohol violation. The SAP will perform the necessary evaluations and must provide the company with a final evaluation that the individual can submit to a return to duty test. An individual that has violated the DOT drug and alcohol testing program by testing positive or refusing to test, needs to complete the recommended follow-up testing protocol as outlined by the SAP. The completion of the follow-up testing protocol is mandatory and tracked since 2020 for FMCSA covered employees in the FMCSA Clearinghouse Database. Prior to an employer hiring an employee for FMCSA covered work the employer is required to check the database to see if the employee is precluded from performing safety sensitive work.
